MAA Sales, Withdrawal, Cancellation, and Refund Policy

1. General Cancellation Policy

The cancellation policy applies to individuals who wish to cancel their enrollment or booking in the courses and workshops of Madrid Academy of Art S.L., hereinafter referred to as MAA. Registering for any MAA course or workshop implies acceptance of the following conditions:

 

2. Applicable Regulations

These General Contracting Terms are subject, among others, to the provisions of Law 7/1998, of April 13, on General Contracting Conditions; Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws; Organic Law 15/1999, of December 13, on the Protection of Personal Data; Law 7/1996, of January 15, on Retail Trade; and Law 34/2002 of July 11, on Services of the Information Society and Electronic Commerce, along with any other applicable regulations.

 

2. Bookings

Users may register for a course or workshop by sending the registration form they received via WhatsApp or email. The Madrid Academy of Art (MAA) will always confirm the registration and reservation of the course through the same communication channel used for registration.

After the online form has been submitted and the student has been admitted, they will be requested to make a payment for the non-refundable deposit to reserve and confirm their spot.

The non-refundable deposit is set at €345 or 10% of the total course fee, whichever amount the student is registering for.

Upon receipt of this deposit, the student will receive a confirmation of their registration. The remaining course fee must be paid by the deadlines specified by the Administration Department via email upon confirming the spot. Payment is required in advance, at the rate of one payment per term.

Should the non-refundable deposit not be paid by the specified deadline, the spot will become available to another interested student.

If the term/course fee is not paid before the course begins, the Madrid Academy of Art will contact the student for clarification.

In the absence of a response, or if the payment is not settled by the start of the course/term, the student's enrolment will be cancelled, and they will forfeit the right to attend any part of the term/course.

 

3. Cancellation of Online Courses or Presential Courses

The buyer of any course has the right to cancel their registration, provided they communicate this within a period of 14 days from booking the service and before the course has started.

Cancellations must be communicated to MAA by email at admin@madridacademyofart.com.

MAA will reimburse the user within 14 days from the date of cancellation notification.

For presential course registrations, cancellations are not permissible once the course has started.

For online course registrations, cancellations are not permissible if the user has already accessed or downloaded the provided materials or recordings. This is because it is considered that the initially booked service has been fully provided.

 

4. Cancellation Fees

Cancellations must be notified by email to admin@madridacademyofart.com. Cancellations communicated through any other means will NOT be accepted.

In the cancellation email, the student must include all registration details, including their name, surname, the date, and contact information.

If a student cancels the course/workshop after it has started, no refund will be issued unless the student can provide justification of force majeure.

Force majeure refers to a highly serious or urgent situation. In such cases, the student is required to provide the necessary documentation for MAA to verify the situation’s validity.

The Direction Committee will assess each case individually, and the Administration Department will inform the student of the final decision. This decision will be conclusive and final.

In the event of cancellation, MAA will retain the non-refundable deposit made to reserve the student’s spot.

Additionally, if the cancellation occurs 30 days or less before the start of the course, MAA will apply a cancellation fee according to the following scale:

  • 30 days before the course start: 100% refund of the course fee to the student (excluding the non-refundable deposit).
  • Between 30 and 14 days before the start of the course: 80% refund of the course fee to the student (excluding the non-refundable deposit).
  • Between 14 and 5 days before the start of the course: 50% refund of the course fee (excluding the non-refundable deposit).
  • After the course has started: no refund is possible.

MAA will process the refund to the student within 15 days following the cancellation request, via bank transfer to the initial purchaser of the course.

The refunded course and registration fees (as per the percentages mentioned above) may be applied as credits towards other MAA courses within one academic year.

 

5. Policy on Changes and Modifications to Registrations

Any request by the student to modify their registration after it has been confirmed will incur an administrative fee. This fee applies to all changes made 30 days or fewer before the start of the course. Registration changes are permitted only in the following scenarios:

  • The student wishes to add an additional course to their initial registration.
  • Space is available in the desired course, with the final decision resting with the Administration Department.

Administrative Fees for Registration Changes:

A fee equivalent to 5% of the price difference between the initially registered course fee and the fee for the newly registered course will be charged.

Should a request to modify the registration be made during the term in which the student is currently enrolled, this fee will increase to 10% of the price difference between the initially registered course fee and the fee for the newly registered course.

These conditions ensure that students are aware of the implications of making changes to their registrations, promoting a commitment to their chosen courses while allowing for flexibility under specific circumstances.

 

6. Cancellation Policy

The Madrid Academy of Art (MAA) reserves the right to postpone or cancel any in-person course if there are insufficient enrolments, or if the instructors, due to justifiable reasons, are unable to conduct the course.

Should any course be postponed or cancelled under these circumstances, all payments made for such registrations will be fully refunded. Students will not be entitled to request any form of compensation beyond the reimbursement of their payments.

 

7. Policy for Missed Classes

Any session, class, or course missed by a student can only be rescheduled under the following conditions:

  • The student must justify their absence for medical reasons, providing the school with proof of a medical appointment or a doctor’s certificate of illness.
  • The student must notify the school of their absence via email at admin@madridacademyofart.com at least one day before the scheduled session.
  • Availability of places allows for rescheduling, with the final decision resting with the Administration Department.

 

8. Intellectual and Industrial Property

The contents provided by the Madrid Academy of Art (MAA) are protected under intellectual and industrial property rights and remain the exclusive property of the MAA or the duly notified individuals or legal entities.

The acquisition of a product and/or service from the MAA does not grant the purchaser any rights for alteration, exploitation, reproduction, distribution, or public communication of these materials.

The transfer of such rights will only be permitted with the prior written consent of the rights holder. While the MAA has sourced the information and materials on its website and online learning platform from reliable sources, and reasonable efforts have been made to ensure their accuracy, the MAA cannot guarantee their completeness, accuracy, or currentness at all times. As such, reliance on this information as if it were unquestionably accurate is not advised.

The MAA expressly disclaims any liability for errors or omissions in the information presented on its website and online learning platform.

Registration in any program, course, or event offered by the MAA is deemed an acceptance of these policies, terms, and conditions.

Should there be any breach of these terms, legal action may be initiated. For the resolution of any disputes arising from the interpretation or execution of these clauses, the MAA and the student, renouncing any other jurisdiction that may apply, agree to submit to the jurisdiction of the Courts and Tribunals of Madrid.
